Terms of Service
These Terms of Service (“Terms”) govern your use of jblinguisticsllc.com (the “Site”) and any language tutoring, translation, interpretation, certification, capability, or training service (each a “Service”) provided by JB Linguistics LLC (“JB Linguistics,” “we,” “us”). By using the Site or engaging a Service, you agree to these Terms.
1. Eligibility
You must be at least 18 years old (or have a parent or guardian agree on your behalf) to enter into a contract with us. By engaging a Service, you represent that you have the legal authority to do so on behalf of yourself or the organization you represent.
2. Scope of services
JB Linguistics provides language tutoring, certified document translation, on-site and remote interpretation, aviation English (ICAO Level 4), corporate language training, homeschool language curricula, and institutional language-access services (parent interpretation, ELL/ESL support, document translation, RFP delivery). The exact scope, deliverables, schedule, and price for any engagement are set out in a written proposal, statement of work, or quote (collectively, the “Engagement Document”).
3. Quotes and proposals
Quotes provided through the Site or in writing are valid for thirty (30) days from issuance unless otherwise noted. Quotes are estimates based on the information you supply; final pricing may change if the scope, volume, deadline, language pair, or complexity changes after work begins. We will notify you of any material change before continuing work.
4. Payment
- Individuals and small businesses: payment is due upon delivery or as set out in the Engagement Document. We accept major payment methods.
- Institutional clients (schools, districts, universities, government, nonprofits): payment terms are net 30 from invoice date unless otherwise agreed. Purchase orders are accepted.
- Past-due invoices may accrue interest at the lower of 1.5% per month or the maximum permitted by law.
- You are responsible for applicable taxes.
5. Confidentiality
We treat materials you share for translation, interpretation, or training as confidential. Every linguist we assign signs a per-engagement confidentiality agreement before receiving materials. For protected health information, we use HIPAA-aligned handling. For school-district student records, we follow FERPA-aligned workflows. You agree to keep our proposals, pricing, methodologies, and proprietary materials confidential as well.
6. Intellectual property
Upon full payment, the final deliverables (translated documents, training materials prepared specifically for you) are licensed to you for your use. We retain ownership of our underlying methods, glossaries, templates, and pre-existing intellectual property. We may use anonymized, non-confidential aggregated information about engagements (e.g., language pair, document type) for portfolio and quality-improvement purposes.
7. Certified translations
Where we issue a certificate of accuracy with a translation (e.g., for USCIS or court filings), the certification attests to the accuracy of the translation as of the date of issue. We are not responsible for downstream rejection by any third party whose acceptance criteria fall outside ATA-standard certification practice.
8. Interpretation services
Booked interpretation slots that are cancelled with less than 24 hours’ notice may be billed at 50% of the scheduled fee; no-shows may be billed at 100%. Specific rescheduling and cancellation terms are stated in the Engagement Document.
9. Acceptable use of the Site
When using the Site, you agree not to:
- Submit false, misleading, or unlawful information through any form.
- Scrape, harvest, or otherwise collect data from the Site by automated means without our written consent.
- Attempt to access non-public areas (such as the admin dashboard) or interfere with the Site’s security.
- Use any of our Services to facilitate illegal activity.
10. Teacher and translator applications
Profile submissions through the apply form are reviewed prior to publication. Submission does not guarantee inclusion in our network. We may remove or edit published profiles at any time. By submitting, you grant us a non-exclusive license to display the profile content (including any photo you upload) on the Site.
11. Third-party links and services
The Site links to third-party platforms (YouTube, Instagram, LinkedIn, Facebook, X, Netlify Forms, Google Ads, Google Analytics). We are not responsible for the content or practices of those services; their use is governed by their own terms.
12. Disclaimer
The Site and our Services are provided “as is.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, except as expressly stated in an Engagement Document.
13. Limitation of liability
To the maximum extent permitted by law, JB Linguistics LLC’s total liability arising out of or related to any Engagement Document is limited to the fees paid for the specific Service giving rise to the claim during the twelve (12) months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages. Nothing in these Terms limits liability for fraud, gross negligence, or anything else that cannot lawfully be limited.
14. Indemnification
You agree to indemnify and hold harmless JB Linguistics LLC from any third-party claim arising out of your breach of these Terms, your misuse of the Site, or the content you provide for translation or interpretation.
15. Termination
Either party may terminate an engagement as set out in the Engagement Document. We may suspend your access to the Site at any time for violation of these Terms. Sections that by their nature survive termination (confidentiality, payment for work performed, intellectual property, disclaimer, limitation of liability) will continue in effect.
16. Governing law and disputes
These Terms are governed by the laws of the State of Arizona, United States, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Maricopa County, Arizona, and both parties consent to that jurisdiction.
17. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent revision. Continued use of the Site or our Services after a change constitutes acceptance of the revised Terms.
